What is Probate in Washington?

Probate is the court‑supervised process of transferring a person’s assets after they pass away. The court makes sure debts are paid and remaining property is distributed according to a Will—or, if there’s no Will, according to Washington intestacy laws.

Washington probate is administered through the Superior Courts, and the process is governed by the Trust and Estate Dispute Resolution Act (TEDRA) and Title 11 of the Revised Code of Washington. For estates that may be subject to Washington’s state estate tax — which applies to estates exceeding approximately $2.193 million — proper administration and tax filing are especially critical.

  • Resolving disputes through TEDRA proceedings

  • Advising on trust administration when probate may not be required
  • Filing Washington estate tax returns for qualifying estates

No matter where you are in the process, we offer practical solutions and responsive support.

What to Expect During Probate in Washington

Our approach is personal and proactive. We want you to feel supported, not overwhelmed.

1. We Begin With Clarity and Support

You don’t have to learn Washington probate law overnight. We explain what’s required, answer your questions, and lay out a clear plan from the start. We’ll handle the technical steps while you focus on your family.

2. We Keep You Informed

Probate can involve detailed timelines, filings, and communication with the court. We break it down for you in plain language, so you always know what’s happening and why.

3. We Reduce the Burden

From preparing court petitions to notifying beneficiaries and creditors, we handle the paperwork and deadlines. Our goal is to make the process as efficient and stress‑free as possible.

4. We Offer Transparent Fees

Unlike some states with statutory fee schedules, Washington does not set probate attorney fees by formula. We explain our fee structure upfront, and in many uncontested cases we can work on a flat‑fee basis. For more complex or contested estates, we’ll provide an estimate and billing details so there are no surprises.

Types of Probate in Washington

Every estate is different, and the type of probate you need depends on your loved one’s situation.

Nonintervention Administration

Washington’s most common probate process is nonintervention administration — similar to independent administration in other states. Once the court grants nonintervention powers, the personal representative can manage most tasks without further court approval, including selling property, paying debts, and distributing assets. We assist with:

  • Filing the Will and petition for probate in the appropriate Washington Superior Court
  • Obtaining Letters Testamentary or Letters of Administration
  • Requesting nonintervention powers from the court
  • Publishing the required notice to creditors
  • Preparing and filing the estate inventory
  • Managing and distributing assets according to the Will
  • Filing the Declaration of Completion to close the estate

Intervention (Court-Supervised) Administration

When nonintervention powers are not granted — or when an heir objects — the court supervises each step of the process. This is more common in contested estates or when the Will doesn’t grant nonintervention authority. We guide clients through the additional court approval requirements.

Probate Without a Will (Intestate Administration)

If there is no Will, Washington intestacy laws determine who inherits. Community property passes entirely to the surviving spouse, while separate property is divided between the spouse and other relatives according to a statutory formula. We help you:

  • Petition the court for appointment as administrator
  • Determine and verify heirs under Washington’s intestacy rules
  • Post the required bond (unless waived by the court)
  • Handle disputes that may arise between heirs

Small Estate Procedures

Washington offers simplified procedures for smaller estates:

  • Small Estate Affidavit (RCW 11.62.010) – For estates with personal property valued at $100,000 or less, heirs can collect assets with a signed affidavit 40 days after death, without any court filing
  • No-probate community property agreements – If the deceased and surviving spouse had a community property agreement, most or all property may pass outside of probate entirely

We’ll evaluate whether these faster, less expensive options fit your situation.

Trust Administration

If your loved one’s assets are held in a trust, probate may not be required at all. We help trustees administer the trust, meet legal obligations under the Washington Trust Act (RCW 11.98), communicate with beneficiaries, file required tax returns, and ensure distributions are made as intended.

Understanding the Washington Estate Tax

Washington imposes its own estate tax with an exemption of approximately $2.193 million — one of the lowest state thresholds in the nation. Given Washington’s high property values, especially in the Puget Sound region, even families with a single home and retirement savings can find themselves over the threshold.

Washington estate tax rates are graduated, ranging from 10% to 20% on taxable amounts. Proper estate administration requires timely filing of the Washington estate tax return (within nine months of death) and accurate valuation of all estate assets.

We work with families and their financial advisors to ensure proper tax return preparation, explore available deductions, and coordinate with federal estate tax obligations when applicable.

TEDRA: Resolving Estate Disputes

Washington’s Trust and Estate Dispute Resolution Act (TEDRA) provides a streamlined process for resolving probate and trust disputes outside of traditional litigation. TEDRA encourages mediation and agreement among parties, and allows courts to approve binding resolutions efficiently. We use TEDRA proceedings to resolve:

  • Will contests and challenges
  • Disputes between beneficiaries and personal representatives
  • Trust interpretation disagreements
  • Accounting objections
  • Claims of undue influence or lack of capacity

Why Planning Ahead Matters

Probate is smoother when there’s a well‑crafted estate plan — and in Washington, planning ahead can also save your family significant estate taxes. Without planning:

  • The state—not you—decides who inherits your property.
  • Your family may face court costs, delays, and potential estate taxes.
  • Assets might be tied up for months or longer.

We also help clients design estate plans that minimize or avoid probate entirely through tools like:

  • Revocable living trusts
  • Community property agreements (allowing property to pass to a surviving spouse without probate)
  • Transfer-on-death deeds (available in Washington under RCW 64.80)
  • Beneficiary designations on accounts and insurance policies
  • Joint tenancy with right of survivorship

Planning now gives your family clarity later.
